Platform Acceptable Use Policy (AUP)

This AUP defines the permitted and prohibited uses of the DEEP Digital Evidence Ecosystem & Protocols Platform (the “Platform”). It applies to all members, authorized users, and other parties accessing or using the Platform under an applicable subscription or license agreement.

Overview

This Platform Acceptable Use Policy (AUP) defines the permitted and prohibited uses of the DEEP Digital Evidence Ecosystem & Protocols Platform (the “Platform”).

It applies to all members, authorized users, and other parties accessing or using the Platform under an applicable subscription, license, or participation agreement.

This AUP is intended to:

  • Protect the integrity, security, and reliability of the Platform
  • Support lawful, ethical, and responsible use
  • Clarify user responsibilities when accessing, contributing, or publishing content

Use of the Platform is permitted only in accordance with this AUP, the applicable Subscription Agreement, and the DEEP Terms of Use.

Scope

This policy applies to:

  • All access to and use of the Platform
  • All components, assets, data, and content published, accessed, or shared through the Platform
  • All actions performed by authorized users on behalf of a member organization

Permitted Use

Users may access and use the Platform solely to:

  • Search, access, and manage components and assets made available through the Platform
  • Publish components or assets for which they hold the necessary rights and permissions
  • Participate in missions and ecosystem collaboration features provided by DEEP
  • Use Platform content for internal business, research, or collaboration purposes, as permitted under applicable agreements

All use must comply with applicable laws and regulations and remain within the scope of the user’s authorization level and subscription.

Prohibited Use

Users must not use the Platform to:

  • Engage in unlawful, fraudulent, deceptive, or misleading activities
  • Upload, store, or process patient data or other data subject to ICH‑GCP or equivalent clinical data protection requirements
  • Infringe, misappropriate, or violate intellectual property, privacy, or other third‑party rights
  • Publish content that is false, misleading, defamatory, or otherwise inappropriate
  • Imply endorsement, certification, regulatory approval, or affiliation by DEEP or any regulatory authority where none exists
  • Circumvent Platform security, access controls, or usage limitations
  • Interfere with, disrupt, or compromise the integrity, availability, or performance of the Platform

Content and Publishing Responsibilities

When publishing components or assets to the Platform, users confirm that:

  • They are the rightful owner of the content or have obtained all necessary licenses, consents, and permissions
  • The content does not infringe third‑party intellectual property, privacy, or other rights
  • The content complies with all applicable laws, regulations, and contractual obligations

Users remain solely responsible for any content they publish and for the consequences of its use by others within the Platform.

Intellectual Property

  • Members retain ownership of the components and assets they publish to the Platform, subject to applicable agreements
  • DEEP and its licensors retain all intellectual property rights in and to the Platform itself
  • Platform content may only be accessed and used within the Platform and for permitted purposes
  • Content must not be reused, redistributed, or modified outside the Platform unless explicitly authorized

Monitoring, Enforcement, and Removal

DEEP reserves the right to:

  • Monitor Platform usage for compliance with this AUP and applicable agreements
  • Remove or restrict access to content that violates this policy
  • Suspend or terminate access where misuse, non‑compliance, or risk to the Platform is identified

Enforcement actions may be taken with or without prior notice, in accordance with applicable agreements.

Disclaimer

  • DEEP does not endorse, validate, or guarantee the accuracy, completeness, or suitability of content published by members
  • Components and assets may originate from third parties or public sources and are provided “as is”
  • Users rely on Platform content at their own risk and remain responsible for compliance with applicable laws and regulations

Updates and Governance

  • DEEP USA may update this Platform Acceptable Use Policy at any time, with or without notice
  • Continued use of the Platform constitutes acceptance of the current version
  • This policy does not replace or override obligations set out in applicable subscription, license, or participation agreements
